These Terms and Conditions govern your use of the Watch Pharaohs website (watchpharaohs.com) and the purchase of products from our online store. By placing an order, you agree to these terms.

Watch Pharaohs is a luxury watch dealer registered in the Netherlands. These terms are governed by Dutch law and comply with applicable EU consumer protection legislation, including the Consumer Rights Directive (2011/83/EU) as implemented in the Dutch Civil Code (Burgerlijk Wetboek).

1. Definitions

• "We", "us", "our" refers to Watch Pharaohs.
• "You", "customer" refers to the person placing an order on our website.
• "Products" refers to the luxury watches and accessories sold on our website.
• "Website" refers to watchpharaohs.com.

2. Orders and Contract Formation

By placing an order on our website, you make an offer to purchase the selected products. A binding contract is formed when we send you an order confirmation by email. We reserve the right to refuse or cancel any order, for example in the event of pricing errors, stock unavailability, or suspected fraud.

3. Prices and Payment

All prices displayed on our website are in Euros (EUR) and include Dutch VAT (BTW) at the applicable rate, unless otherwise stated. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time of checkout.

We accept payment via the methods listed at checkout. Payment must be made in full before your order is dispatched.

4. Delivery

We aim to dispatch orders within the timeframe stated on the product page or at checkout. Delivery times are estimates and not guaranteed. Risk of loss and title for products pass to you upon delivery. We are not liable for delays caused by third-party carriers or circumstances beyond our control.

We ship within the Netherlands and to other EU countries. Shipping costs and estimated delivery times are displayed at checkout.

5. Right of Withdrawal (Herroepingsrecht)

As a consumer purchasing online, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, in accordance with Article 6:230o of the Dutch Civil Code.

To exercise this right, you must notify us within the 14-day period by sending a clear statement (e.g., by email) to the contact details below. You may use the standard withdrawal form provided by Dutch law, but this is not mandatory.

After notifying us, you must return the product within 14 days. Products must be returned in their original condition, unworn, and with all original packaging and documentation. You are responsible for the cost of return shipping unless the product is defective or incorrectly delivered.

We will refund the full purchase price, including standard delivery costs, within 14 days of receiving the returned product or proof of return, whichever is earlier. Refunds will be made using the same payment method used for the original transaction.

Exceptions: The right of withdrawal does not apply to products that have been personalised or custom-made to your specifications.

6. Warranty and Conformity

All products sold by Watch Pharaohs must conform to the purchase agreement. Under Dutch law (Article 7:17 BW), you are entitled to a legal guarantee that the product is free from defects and functions as described at the time of delivery.

If a product is defective or does not conform, please contact us within a reasonable time of discovering the defect. We will repair, replace, or refund the product as appropriate. This legal guarantee is in addition to any manufacturer's warranty that may apply.

7. Liability

Our liability is limited to the maximum extent permitted by Dutch law. We are not liable for indirect or consequential damages. Our total liability for any claim shall not exceed the purchase price of the product in question.

8. Intellectual Property

All content on our website, including images, text, logos, and product descriptions, is the property of Watch Pharaohs or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce or use any content without our prior written consent.

9. Privacy

We process your personal data in accordance with our Privacy Policy and applicable GDPR regulations.

10. Complaints

If you have a complaint about our products or services, please contact us first. We aim to resolve complaints within 14 days. If we are unable to resolve your complaint, you may contact the Dutch consumer dispute resolution body (Geschillencommissie) or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by Dutch law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

12. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. The version in force at the time of your order will apply to that order.
